FMCSA Safety Ratings, Carrier Vetting and UCR: What Montgomery Means for Transportation Businesses

A carrier’s FMCSA safety rating and Unified Carrier Registration status answer different questions.

The safety rating concerns the carrier’s compliance with federal safety-fitness standards.

UCR concerns an annual registration and fee obligation for qualifying transportation businesses.

Both may be relevant when a broker or shipper reviews a transportation company.

But neither substitutes for the other.

The Supreme Court’s 2026 decision in Montgomery v. Caribe Transport II, LLC has increased attention on carrier selection and public safety information.

For covered transportation businesses, the practical lesson is to understand their safety records while keeping annual registration obligations current.

What Did Montgomery v. Caribe Decide?

The case involved a serious truck collision and a negligent-hiring claim against the broker that arranged the shipment.

The plaintiff alleged that the selected motor carrier had a Conditional FMCSA safety rating and other safety concerns.

On May 14, 2026, the Supreme Court held that the type of state-law negligent-hiring claim presented was not preempted by the Federal Aviation Administration Authorization Act because it fell within the motor-vehicle safety exception.

The case was remanded for further proceedings.

The Court did not determine that the broker was negligent or establish a mandatory federal carrier-screening checklist.

Why Does Carrier Vetting Matter?

Brokers and shippers may review a carrier’s operating authority, insurance, safety rating, and available compliance information before assigning freight.

That review may identify concerns requiring further investigation.

However, no single field necessarily answers every question.

A carrier’s annual UCR payment is an administrative obligation, not proof of its safety performance.

Similarly, a favorable safety rating does not establish that annual UCR registration has been completed.

What Are FMCSA’s Safety Rating Categories?

StatusGeneral meaning
SatisfactoryAdequate safety management controls under the formal rating process
ConditionalInadequate safety management controls under the applicable criteria
UnsatisfactoryMost serious formal adverse rating, with operating consequences once final
UnratedNo formal safety rating assigned

Unrated does not mean that the carrier has failed a safety review.

It also does not mean the carrier has received a federal guarantee of safe operations.

Does a Conditional Rating Automatically Prohibit Operation?

No.

A Conditional rating identifies deficiencies in safety management controls.

It can be an important consideration during carrier selection.

However, it does not by itself create the operating prohibition associated with a final Unsatisfactory rating.

The carrier should address the underlying deficiencies and follow any applicable FMCSA procedures.

Is a Satisfactory Rating Enough to Approve a Carrier?

Not necessarily.

A Satisfactory rating is a favorable formal determination.

It does not guarantee that the carrier has maintained the same safety performance since the rating was issued.

Brokers may consider more recent information when conducting an appropriate review.

Montgomery did not establish that a Satisfactory rating eliminates all potential negligent-hiring concerns.

What Does Unrated Mean for Brokers?

Unrated means no formal safety rating has been assigned.

It is not equivalent to Conditional or Unsatisfactory.

A broker should not assume that an Unrated carrier is unsafe solely because the rating field is blank or indicates no rating.

Other relevant, lawfully available information may provide context.

What Is Unified Carrier Registration?

Unified Carrier Registration is an annual registration and fee program for qualifying interstate and international transportation businesses.

Covered entities may include motor carriers, motor private carriers of property, freight brokers, freight forwarders, and leasing companies.

UCR is separate from federal operating authority and FMCSA safety ratings.

A business subject to UCR must register for each applicable year.

When Did 2027 UCR Registration Open?

The official 2027 UCR registration period opened October 1, 2026.

Businesses can register directly through the National Registration System at UCR .

A 2026 registration does not automatically cover 2027.

What Is the 2027 UCR Deadline?

Covered businesses must register and pay before January 1, 2027.

The practical deadline is December 31, 2026.

Carriers and brokers should verify that the official record shows a completed registration.

What Are the Approved 2027 UCR Fees?

The official 2027 UCR fees are:

Qualifying commercial motor vehicles2027 fee
0–2$55
3–5$167
6–20$333
21–100$1,163
101–1,000$5,548
1,001 or more$54,165

Covered brokers and leasing companies pay $55.

Official registration fees are separate from optional private filing-service charges.

Do Freight Brokers Need UCR?

Covered freight brokers generally must register annually, even when they own no commercial motor vehicles.

The 2027 broker fee is $55.

A broker’s fee is not determined by the number of trucks operated by the motor carriers it hires.

The broker’s own registration obligations remain separate from its carrier-selection practices.

Do Motor Carriers Need UCR?

Qualifying interstate motor carriers generally must register.

The applicable fee bracket depends on the number of qualifying commercial motor vehicles under the UCR counting rules.

A one-truck carrier may fall in the lowest bracket.

Owning only one truck is not a general exemption.

Do Private Fleets Need UCR?

Qualifying interstate motor private carriers of property may be subject to UCR.

This can include businesses transporting their own goods or equipment.

The company’s actual operations and applicable definitions determine coverage.

Does UCR Registration Prove a Carrier Is Safe?

No.

UCR is not a safety certification.

Payment does not create a Satisfactory rating.

It does not remove a Conditional or Unsatisfactory rating.

It does not correct roadside inspection violations or crash records.

Carrier safety and annual registration must be evaluated separately.

Does a Safety Rating Prove UCR Is Paid?

No.

A Satisfactory, Conditional, or Unrated carrier may still need to complete annual UCR registration.

A carrier’s safety rating does not establish the payment status for 2027 or any earlier year.

The official UCR record should be checked separately.

How Can Brokers Verify UCR?

Use the official UCR National Registration System.

Locate the correct company.

Select the relevant registration year.

Review the recorded status.

UCR verification can be one part of an administrative review, but it should not be confused with a complete safety evaluation.

What Other Records Matter During Carrier Selection?

Depending on the circumstances, a broker may review the carrier’s USDOT registration, required operating authority, insurance filings, formal safety rating, and relevant public safety information.

FMCSA’s Safety Measurement System provides additional performance data.

FMCSA warns users not to determine a carrier’s overall safety condition solely from SMS information.

The appropriate legal standard depends on applicable law and the facts.

How Does MCS-150 Relate to UCR?

The MCS-150 maintains company identification and operating information associated with the USDOT number.

UCR is a separate annual registration.

For enrolled 2027 UCR automatic renewals, the UCR Plan uses Option A and the power-unit count on the most current MCS-150.

Carriers should review accurate fleet information before renewal.

Updating MCS-150 does not automatically pay UCR.

Does the Biennial Enforcement Suspension Affect UCR?

No.

FMCSA temporarily suspended enforcement of certain MCS-150 biennial updates and related USDOT-number inactivation for deadlines due on or after June 1, 2026.

The underlying filing requirement remains.

The suspension does not extend the 2027 UCR deadline or change safety-rating obligations.

What If a Carrier Has Unpaid UCR From Earlier Years?

A 2027 payment does not automatically settle unpaid 2026 or earlier registrations.

The business should review each year in which it was subject to UCR.

The applicable fee and registration status must be addressed separately for each year.

How Do You Complete 2027 UCR?

Visit UCR .

Locate the correct business.

Select the 2027 registration year.

Confirm the entity classification.

Determine the qualifying vehicle count and fee bracket.

Complete payment.

Save the confirmation and verify the official registration record.

Private assistance is optional.

Frequently Asked Questions

Did Montgomery change UCR requirements?

No. The decision addressed federal preemption of a state-law negligent-hiring claim.

Does a Conditional safety rating prevent UCR registration?

No. Safety-rating consequences and UCR registration are separate matters.

Does Unrated mean a carrier cannot register for UCR?

No. Unrated means no formal FMCSA safety rating has been assigned.

Do brokers pay UCR in 2027?

Covered brokers generally pay $55.

When is 2027 UCR due?

Covered businesses must register and pay before January 1, 2027.

Does paying UCR establish active operating authority?

No. Operating authority must be verified separately.

Can businesses register directly?

Yes. The official National Registration System supports direct registration.

Keep Annual Registration Separate From Safety Evaluation

Montgomery reinforces the importance of understanding carrier safety information, but it does not turn UCR into a safety-rating program.

Transportation businesses should maintain accurate regulatory records, review safety information in context, and complete each applicable annual registration.
