Non-Domiciled CDL Restrictions and 2027 UCR: What Trucking Fleets Should Know

FMCSA’s 2026 changes to non-domiciled commercial driver’s licenses have created new considerations for trucking companies that employ drivers holding these credentials.

A driver may face additional verification during renewal, transfer, upgrade, or reinstatement. State licensing actions can also affect whether the driver remains eligible to operate a commercial motor vehicle.

For carriers, these changes can affect staffing, dispatch, and fleet planning.

However, an individual driver’s CDL status does not automatically change the company’s Unified Carrier Registration obligations.

With 2027 UCR registration underway, businesses should address both driver qualification and annual registration without confusing the two.

What Changed for Non-Domiciled CDLs?

FMCSA’s non-domiciled CDL final rule became effective March 16, 2026.

The rule narrowed eligibility for certain foreign-domiciled applicants and strengthened state licensing verification.

Under FMCSA’s March 30, 2026 guidance, the qualifying employment-based nonimmigrant statuses for the relevant applicants are H-2A, H-2B, and E-2.

The requirements apply to specified issuance transactions, including renewals and reinstatements.

They do not mean every foreign-born commercial driver must obtain a non-domiciled CDL.

Why Do These Restrictions Matter for Fleet Planning?

A carrier may have enough trucks and freight but temporarily lack an appropriately licensed driver.

A licensing downgrade or unsuccessful renewal can prevent a driver from operating equipment that requires a CDL.

The business may need to reassign loads or arrange qualified replacement capacity.

These consequences depend on the actual licensing circumstances and should not be assumed for every non-domiciled CDL holder.

Are Existing Non-Domiciled CDLs Still Valid?

Some are.

FMCSA strongly encourages states to review previously issued non-domiciled credentials and address those that did not comply with the rules in effect when issued.

A properly issued credential does not automatically become invalid solely because the regulatory framework changed.

Carriers should verify current licensing status rather than rely on broad assumptions.

What Happens When a CDL Expires?

A driver cannot continue operating a vehicle requiring commercial driving privileges after those privileges expire.

Under the revised framework, renewal may require current eligibility verification.

Non-domiciled credentials generally cannot be valid longer than one year or the expiration of the qualifying immigration documentation, whichever occurs first.

Carriers should monitor upcoming expirations and develop backup staffing plans.

Can a State Downgrade a Non-Domiciled CDL?

Yes.

Under specified circumstances involving federal information about loss of qualifying lawful immigration status, states must complete and record the downgrade within 30 days.

A downgrade removes the commercial driving privilege.

The employer should not dispatch a driver whose required privileges are no longer valid.

The licensing agency determines whether the driver qualifies for reinstatement.

Does a CDL Downgrade Automatically Reduce Fleet Size?

No.

A driver’s licensing status and the company’s vehicle inventory are different.

A truck may remain part of the fleet even when its assigned driver cannot operate it.

A carrier should not automatically reduce its reported vehicle count merely because a driver becomes unavailable.

What Is Unified Carrier Registration?

UCR is an annual registration and fee program for qualifying interstate transportation businesses.

Covered entities generally include interstate motor carriers, motor private carriers of property, brokers, freight forwarders, and leasing companies.

UCR is a business registration program.

It does not issue CDLs or determine individual driver qualification.

Does a Non-Domiciled CDL Restriction Cancel UCR?

No.

An individual driver’s CDL restriction does not automatically cancel the employer’s UCR registration.

If the business remains subject to UCR, its annual obligation continues.

Likewise, completing UCR registration does not restore a driver’s commercial driving privileges.

When Is 2027 UCR Due?

The 2027 UCR registration season opened October 1, 2026.

Covered businesses must register and pay before January 1, 2027.

A completed registration for 2026 does not satisfy the 2027 requirement.

Companies should retain confirmation of the registration year and payment.

What Are the Official 2027 UCR Fees?

The UCR Plan has approved the following fee schedule for 2027:

Qualifying vehiclesOfficial 2027 fee
0–2$55
3–5$167
6–20$333
21–100$1,163
101–1,000$5,548
1,001 or more$54,165

Covered brokers and leasing companies pay $55.

These are official UCR fees. Optional third-party filing assistance may involve an additional service charge.

Does the Number of CDL Drivers Affect UCR Fees?

Not directly.

For covered carriers, the UCR fee bracket generally depends on the applicable qualifying commercial motor vehicle count.

The number of drivers holding non-domiciled CDLs is not a separate UCR fee factor.

A carrier with two qualifying vehicles does not automatically move to a higher bracket because it hires additional drivers.

What If Trucks Are Parked Because Drivers Are Unavailable?

Temporarily parking trucks does not automatically remove them from the applicable UCR vehicle count.

The correct bracket depends on the UCR Plan’s counting rules and relevant reporting information.

Carriers should not assume that short-term staffing disruptions reduce annual registration fees.

What If a Carrier Permanently Reduces Its Fleet?

A permanent change in qualifying commercial motor vehicles may affect the applicable UCR bracket.

The company should review the UCR counting rules and the information maintained in its USDOT registration.

A driver leaving employment is not necessarily the same as a vehicle leaving the fleet.

Evaluate the actual operational change.

How Does MCS-150 Information Relate to UCR?

The MCS-150 maintains company information associated with a USDOT registration, including reported power units.

The UCR Plan’s October 2026 guidance explains that certain enrolled automatic renewals use the power-unit count from the most current MCS-150.

Accurate company information can therefore matter during renewal.

However, filing an MCS-150 does not itself complete annual UCR registration.

Does Motus Replace UCR?

No.

FMCSA’s Motus system supports applicable USDOT registration and company-account transactions.

UCR registration is completed through a separate program.

Neither system determines whether an individual qualifies for a non-domiciled CDL.

What Should Owner-Operators Know?

An owner-operator must hold the appropriate commercial driving privileges for the vehicle and operation.

A licensing issue may interrupt the business’s ability to provide transportation.

That does not automatically eliminate separate registration obligations.

For 2027, the official UCR fee for a covered carrier in the zero-to-two-vehicle bracket is $55.

An owner-operator who permanently ceases operations should review the appropriate registration procedures rather than assume that an expired CDL automatically closes the business record.

Do Private Fleets Need UCR?

Qualifying interstate motor private carriers of property generally must register.

A manufacturer, distributor, or other business transporting its own property may be covered.

Its annual UCR obligation is separate from the licensing status of individual drivers.

Private fleets should review both driver qualification and company registration.

Do Freight Brokers Need UCR?

Covered freight brokers generally must register annually even if they own no trucks.

The official 2027 broker fee is $55.

A carrier’s driver licensing issue does not automatically change the broker’s separate UCR obligation.

Brokers should maintain appropriate carrier-vetting and contingency procedures when arranging transportation.

How Can Carriers Prepare for Driver Availability Changes?

Review CDL expiration dates and current licensing status.

Maintain appropriate driver qualification records.

Track medical certification and Clearinghouse requirements.

Identify qualified backup drivers where practical.

Create procedures for notifying dispatch when a driver becomes unavailable.

Apply objective qualification standards without making assumptions about nationality or immigration background.

Does English-Language Proficiency Affect UCR?

No, not directly.

English-language proficiency is a separate driver qualification requirement under 49 CFR § 391.11(b)(2).

It is not a UCR fee factor.

Carriers should evaluate applicable language proficiency requirements consistently and independently from non-domiciled CDL status.

What Happens If UCR Registration Is Late?

The UCR Plan states that registration fees remain due after the deadline and that nonregistrants may face state enforcement.

Consequences depend on the applicable jurisdiction.

A late UCR payment is not the same as an individual CDL downgrade.

Both matters must be resolved through their appropriate procedures.

How Do You Register for 2027 UCR?
